Independent Contractor vs. Employee & the possible implications. Plus an FLSA Regulations update Larry Morgan, MAIR, GPHR, SPHR Samuel Diehl (Guest Speaker from Gray Plant Mooty) July 13 2010 The Department of Labor has proposed a new requirement that employers notify employees with a list of their rights under the Fair Labor Standards Act (federal law covering overtime, minimum wage and child labor issues) regarding hours worked and wage computations. Employees listed as exempt from overtime (not eligible) would have a classification analysis completed with the analysis disclosed to the employee and retain the analysis in the event of an audit. In addition, the Employee Misclassification Prevention Act is working its way through the house and the senate. The act would amend the FLSA and require employers to keep records of non-employees who perform labor or services and provide a special penalty for employers misclassifying persons as non-employees.
